Grimes Is Suing Elon Musk For the Parental Rights of Their Three Children
The news comes after Grimes's tweet to Musk asking to see her son.
Less than a month after news broke that Elon Musk and Grimes secretly welcomed a third baby — the bombshell dropped in Walter Isaacson's biography of the Tesla CEO, Elon Musk — Page Six reports that Grimes (née Claire Elise Boucher) filed a “petition to establish parental relationship” on Sept. 29 in California. While that may sound complicated, the outlet notes that it is a request that "intends to have the court identify the legal parents of a child when they are unmarried." Filings have been sealed, even though the docket was public information, but Musk has yet to respond to the petition. Page Six adds that Grimes did not request child support or custody rights.
Grimes and Musk welcomed their first child, a son that they named X Æ A-Xii, back in May 2020. The on-again, off-again couple would then go on to welcome a daughter, Exa Dark Sideræl, whom they call Y, via surrogate in December 2021. However, it wasn't until Isaacson's book hit shelves that the public learned about their third child, a son named Techno Mechanicus. They call him Tau for short. Neither Grimes nor Musk have shared exactly when Tau was born.

The petition comes just weeks after the musician pleaded on Twitter with Musk to allow her to see their son. The tweet has since been deleted, but it read, "Tell Shivon to unblock me and tell Elon to let me see my son or plz respond to my lawyer. I have never even been allowed to see a photo of these children until this moment, despite the situation utterly ripping my family apart.” The message was in response to Shivon Zilis posting a photo of Musk's children. Zilis is the mother to Musk's twins, Strider and Azure. They were born in Nov. 2021.
“I spoke with Shivon at length finally, which was long overdue. This wasn’t her fault, plz don’t be angry at her!” Grimes wrote days after the initial tweet. “We respect each other a lot and we’re excited to become friends and have the kids grow up together.”
